Please read these Terms & Conditions carefully before using the Pith & Co website or engaging our services. By accessing this website or proceeding with a service engagement, you agree to be bound by these terms. If you have questions about any section, we are happy to discuss them with you before any agreement is reached.

1. Acceptance of Terms

These Terms & Conditions govern your use of this website and the services provided by Pith & Co. By using this website or entering into a service engagement with us, you confirm that you have read, understood, and agree to these terms.

We reserve the right to update these terms from time to time. Continued use of the website following any changes constitutes acceptance of the revised terms.

2. Our Services

Pith & Co offers three interior design services: Initial Space Reading, Design Composition & Visualization, and Realization & Finishing. Each service is described on the Solutions page of this website.

Services are provided for residential spaces (apartments, homes, studios) and boutique hospitality projects in Malaysia. We reserve the right to decline engagements that fall outside the scope of our practice.

3. Service Engagements

A service engagement begins when both parties have signed a written agreement (or letter of engagement) confirming the scope of work, timeline, deliverables, and fees. Work does not commence prior to this agreement being in place.

Any verbal discussions, quotations, or preliminary consultations prior to a signed agreement are exploratory and do not constitute a binding commitment by either party.

Each engagement is documented in writing before any work begins. You will receive a clear description of what is included, the expected timeline, the deliverables you will receive, and the fees applicable.

4. Fees and Payment

Fees for each service are as published on this website and confirmed in your written engagement agreement. Prices are in Malaysian Ringgit (MYR) and inclusive of applicable taxes unless otherwise stated.

Standard payment terms are:

• Initial Space Reading: Full payment due upon confirmation of booking.
• Design Composition & Visualization: 50% upon signing the engagement agreement; 50% upon delivery of the completed design book.
• Realization & Finishing: Payment schedule agreed in the engagement letter, typically staged across project milestones.

Payments may be made by bank transfer to the account details provided in your engagement agreement or invoice. We do not accept cash payments above MYR 1,000 in compliance with applicable financial regulations.

Overdue invoices are subject to interest at a rate of 1% per month on the outstanding amount, calculated from the due date.

5. Changes to Scope

If you wish to change the scope of work after an engagement has begun, please notify us in writing. We will assess the request and provide a written summary of any adjustments to fees, timeline, or deliverables before proceeding.

We understand that design decisions evolve and we approach scope changes with flexibility. Any agreed changes will be documented as an amendment to the original engagement agreement.

6. Intellectual Property

All design work produced by Pith & Co — including spatial plans, visualizations, mood directions, material schedules, and design books — remains the intellectual property of Pith & Co until all fees for the relevant service have been paid in full.

Upon full payment, the client is granted a non-exclusive, non-transferable licence to use the design work for the specific project for which it was created. This includes the right to share the design documentation with contractors and suppliers engaged for that project.

Pith & Co retains the right to photograph and document completed projects for portfolio purposes. We will always seek written permission before publishing or publicly sharing images of your space.

7. Confidentiality

We treat all project information with discretion. Details of your project, property, preferences, and personal circumstances shared with us in the course of an engagement will not be disclosed to third parties without your consent, except as necessary to deliver the agreed services (for example, sharing specifications with a contractor).

This commitment to confidentiality applies to our entire team and any subcontractors engaged on your project.

8. Limitation of Liability

Pith & Co provides interior design consultation and design services. We are not responsible for the structural integrity of buildings, compliance with building codes or planning regulations, or the quality of workmanship by third-party contractors. Clients are responsible for ensuring that any construction or renovation work is carried out by appropriately qualified contractors.

Our liability to you in connection with any service engagement is limited to the fees paid for that specific service. We are not liable for indirect, consequential, or incidental losses arising from our services.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Cancellation and Termination

Either party may terminate a service engagement by giving written notice. The following terms apply on termination:

• If you cancel before work has commenced: any fees already paid for work not yet begun will be refunded, less an administrative fee of MYR 150.
• If you cancel after work has commenced: fees are payable for all work completed up to the date of notice. The engagement letter will specify how partial work is valued.
• If Pith & Co terminates the engagement due to non-payment or material breach of these terms: fees remain due for all work completed.

10. Website Use

This website and all content on it — including text, images, and design — are the property of Pith & Co and are protected by applicable intellectual property laws. You may not reproduce, distribute, or adapt any content from this website without our written permission.

We make reasonable efforts to ensure the accuracy of information on this website, but we do not warrant that all content is complete, current, or error-free. Prices and service descriptions are subject to change without notice.

Links to third-party websites are provided for convenience only. We are not responsible for the content or practices of external sites.

11. Governing Law

These Terms & Conditions are governed by the laws of Malaysia. Any disputes arising in connection with these terms or our services will be subject to the exclusive jurisdiction of the courts of Malaysia.
